{"id":1164,"date":"2025-06-25T15:58:51","date_gmt":"2025-06-25T15:58:51","guid":{"rendered":"https:\/\/galm.sg-host.com\/?p=1164"},"modified":"2025-07-02T08:04:17","modified_gmt":"2025-07-02T15:04:17","slug":"why-u-s-companies-need-to-pay-attention-to-the-eaa","status":"publish","type":"post","link":"https:\/\/evinced.com\/blog\/why-u-s-companies-need-to-pay-attention-to-the-eaa\/","title":{"rendered":"Why U.S. companies need to pay attention to the EAA"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">If you\u2019re a U.S.-based business, it\u2019s easy to assume that the<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32019L0882\"> European Accessibility Act<\/a> (\u201cEAA\u201d) doesn\u2019t apply to you.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">But if your digital products or services reach consumers in any of the 27 EU member states, that assumption could cost you. The EAA, like the <a href=\"https:\/\/www.edpb.europa.eu\/sites\/default\/files\/files\/file1\/edpb_guidelines_3_2018_territorial_scope_after_public_consultation_en_1.pdf\">General Data Protection Regulation <\/a>&nbsp;(GDPR) before it, has <strong>extraterritorial reach<\/strong>. It protects EU residents no matter where a product originates, so any company doing business in the EU, directly or through partners, falls within its scope.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">There\u2019s no exemption for companies that are American, or Canadian (or Antarctican, for that matter).&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\"><a href=\"https:\/\/accessible-eu-centre.ec.europa.eu\/content-corner\/news\/eaa-comes-effect-june-2025-are-you-ready-2025-01-31_en#:~:text=The%20Act%20mandates%20that%20a%20range%20of,with%20accessibility%20requirements%20for%20persons%20with%20disabilities.\">As of June 28, 2025<\/a>, companies that fall under the EAA\u2019s scope are required to comply with its directives \u2013 or face penalties.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>How to know if your company is subject to the EAA<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">You\u2019re in scope if your product or service is on the market on or after June 28, 2025, and <strong>both<\/strong> of the following are true:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\"><strong>1.<\/strong> <strong>You provide <\/strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32019L0882#art_2\"><strong>a covered product or service<\/strong><\/a><strong> to EU consumers, <\/strong>making you an \u201c<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32019L0882#cpt_III\">economic operator<\/a>\u201d (manufacturer, importer, distributor or service provider)<em>.<\/em> Examples include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"font-size:18px\">Consumer-facing websites or mobile apps that provide e-commerce services<\/li>\n\n\n\n<li style=\"font-size:18px\">General-purpose computer hardware and operating systems&nbsp;<\/li>\n\n\n\n<li style=\"font-size:18px\">Consumer-facing self-service terminals (e.g., ATMs, ticketing kiosks, check-in machines)<\/li>\n\n\n\n<li style=\"font-size:18px\">E-readers and audiovisual media services<\/li>\n\n\n\n<li style=\"font-size:18px\">Online banking, e-books, and digital transport services<\/li>\n\n\n\n<li style=\"font-size:18px\">Electronic communications and emergency services<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">AND<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\"><strong>2.<\/strong> <strong>You\u2019re not an exempt <\/strong><a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=legissum:n26026\"><strong>microenterprise<\/strong><\/a>.<strong> <\/strong>The EAA does not apply to businesses with fewer than 10 employees and less than or equal to \u20ac2 million in global annual revenue (about $2.25 million USD) \u2013 <strong>If they provide<em> <\/em>covered services only<\/strong>. A microenterprise that manufactures, imports, or distributes covered products is still subject to all EAA requirements. [1]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">If both conditions apply, then so does the law. &nbsp;<\/p>\n\n\n\n<div style=\"height:14px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\">Quick check: are you in scope?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">1. Confirm whether your offering appears in the EAA\u2019s <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32019L0882#art_2\">list of covered services or products<\/a>&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">2. Ask yourself:<\/p>\n\n\n\n<ul class=\"wp-block-list has-medium-font-size\">\n<li style=\"font-size:18px\">Do EU consumers use your website\/app to buy, book, watch, read, or bank?<\/li>\n\n\n\n<li style=\"font-size:18px\">Do you sell, ship or license consumer hardware that enables those services?<\/li>\n\n\n\n<li style=\"font-size:18px\">Do you target EU users via local language, currency, domains, or ads?<\/li>\n\n\n\n<li style=\"font-size:18px\">Do you take orders from or support EU residents?&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">3. Apply the micro-enterprise test. You\u2019re exempt only if <em>all<\/em> of the following are true:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"font-size:18px\">You have fewer than 10 employees<\/li>\n\n\n\n<li style=\"font-size:18px\">Your global annual revenue is \u2264 \u20ac2 million<\/li>\n\n\n\n<li style=\"font-size:18px\">You provide services only (no covered physical products)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">A real-world example: Let\u2019s say you\u2019re a U.S. website selling pet food and taking orders from consumers in Belgium. With only 8 employees and \u20ac1 million in revenue, you meet the micro-enterprise thresholds and, as a pure e-commerce service, are exempt. That exemption disappears if you:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"font-size:18px\"><a href=\"https:\/\/www.taylorwessing.com\/de\/interface\/2025\/accessibility\/key-eu-accessibility-act-exemptions-and-the-challenges-they-pose\">Hire more staff<\/a> (e.g. grow to 12 employees), or<\/li>\n\n\n\n<li style=\"font-size:18px\">Launch a smart payment kiosk for in-store reorders (a covered product)<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\" style=\"font-size:18px\">In either case, full EAA compliance would immediately apply.<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\"><strong>Note<\/strong>: When in doubt, consult legal counsel or the competent authority in each EU market where you operate.<\/p>\n\n\n\n<div style=\"height:14px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div style=\"height:12px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What does it mean to comply with the EAA?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">The EAA demands that consumer products and services \u2013 digital or physical \u2013 be accessible, usable, and safe for people with disabilities. Below is a plain-language summary of the EAA\u2019s core<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32019L0882#anx_I\"> accessibility requirements for products and services<\/a>, highlighting the most common, high-impact obligations. The law also offers a list of \u201c<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32019L0882#anx_II\">non-binding examples<\/a>\u201d of practical solutions to support compliance.<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\" style=\"font-size:18px\"><table><thead><tr><th><strong>EAA Requirement<\/strong><\/th><th><strong>What it Means&nbsp;<\/strong><\/th><\/tr><\/thead><tbody><tr><td>Make digital experiences accessible<\/td><td>Websites, apps, and online services must be perceivable, operable, understandable, and robust (<a href=\"https:\/\/www.w3.org\/WAI\/WCAG21\/Understanding\/intro\">the four principles of accessibility<\/a>).<\/td><\/tr><tr><td>Provide information via more than one sensory channel<\/td><td>Offer non-visual and non-auditory alternatives, such as screen-reader output, text-to-speech, captions, or tactile cues.&nbsp;<\/td><\/tr><tr><td>Offer inclusive user interfaces<\/td><td>Features for users who can\u2019t see, hear, speak, or use fine motor skills, e.g. adjustable contrast, magnification, text-to-speech, tactile controls, non-voice login options.<\/td><\/tr><tr><td>Work seamlessly with assistive tech<\/td><td>Interoperate with screen readers, braille displays, hearing aids, etc., while safeguarding privacy and security.<\/td><\/tr><tr><td>Meet sector-specific requirements<\/td><td>Extra rules for transport, banking, media, e-commerce, emergency services, e.g. real-time text, accessible ebooks, sign-language support.<\/td><\/tr><tr><td>Make packaging &amp; product info accessible<\/td><td>Labels, manuals, safety instructions must be available in multiple accessible formats.<\/td><\/tr><tr><td>Keep customer-support channels accessible<\/td><td>Help desks, call centers, and tech support must be reachable via accessible modes and able to explain compatibility with assistive tech.<\/td><\/tr><tr><td>Provide clear compliance documentation<\/td><td>Services: publish a conformance statement.[2]<br>Products: issue an <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32019L0882#art_16\">EU Declaration of Conformity<\/a> and affix a <a href=\"https:\/\/single-market-economy.ec.europa.eu\/single-market\/ce-marking_en\">CE mark<\/a>.&nbsp;<\/td><\/tr><tr><td>Reference <a href=\"https:\/\/www.etsi.org\/human-factors-accessibility\/en-301-549-v3-the-harmonized-european-standard-for-ict-accessibility\"><strong>EN\u202f301\u202f549<\/strong><\/a><strong> <\/strong>(recommended)<\/td><td>The harmonized EU standard builds on <a href=\"https:\/\/www.w3.org\/TR\/WCAG21\/\">WCAG 2.1 Level AA<\/a> with some additional requirements. Conformance with EN 301 549 creates a presumption of EAA compliance.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">These are mostly things your company should be doing anyway (many of our customers are already focusing on <a href=\"https:\/\/www.w3.org\/TR\/WCAG22\/\">WCAG 2.2<\/a>, for example, which is expected to soon be incorporated into an updated EN 301 549). But in the US, where the regulatory picture is a patchwork of laws and rulings from lawsuits, many US companies don\u2019t feel like they are under time pressure to get their accessibility situation straightened out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">But they quite likely are.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">If the EAA applies to you, you\u2019re subject to enforceable penalties as of June 28, 2025.&nbsp; That\u2019s when each EU member state\u2019s version of the law \u2014 adopted through a process called \u201ctransposition\u201d \u2014 goes into effect.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What about B2B companies?<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">The EAA doesn\u2019t regulate B2B transactions. It applies to the economic operator that puts a covered product or service on the EU consumer market \u2014 not to every upstream vendor in its supply chain.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">That said, if your software, platform, or hardware is embedded in a consumer-facing product, you\u2019ll still feel the impact: your <em>customers<\/em> can\u2019t buy inaccessible components from you and remain compliant.<\/p>\n\n\n\n<figure class=\"wp-block-table is-style-stripes\" style=\"font-size:18px\"><table><thead><tr><th><strong>If you are\u2026<\/strong><\/th><th><strong>Are you \u201cin scope\u201d?<\/strong><\/th><\/tr><\/thead><tbody><tr><td>A bank, e-commerce retailer, streaming platform, or kiosk importer\/operator serving EU consumers<\/td><td><strong>Yes.<\/strong> You are the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32019L0882#cpt_III\">\u201cservice provider\u201d, \u201cmanufacturer\u201d , \u201cimporter\u201d or \u201cdistributor\u201d<\/a> defined in the EAA, and have obligations to ensure accessibility.<\/td><\/tr><tr><td>A U.S. SaaS vendor, cloud host, or component supplier that sells to consumer-facing operators in the EU<\/td><td><strong>No.<\/strong> But you will likely be unable to sell your inaccessible software\/hosting service\/device to those operators, because <em>they<\/em> must comply.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>About EAA penalties: how non-compliance can cost you across the EU<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">The European Union doesn\u2019t enforce the EAA directly. Each member state does, so <strong>one accessibility failure can trigger penalties in several countries at once<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">Enforcement may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"font-size:18px\">Administrative fines of up to 10% of your company\u2019s annual turnover (Netherlands [3] and Poland [4])<\/li>\n\n\n\n<li style=\"font-size:18px\">Daily accruing fines for unresolved issues (Cyprus [5])&nbsp;<\/li>\n\n\n\n<li style=\"font-size:18px\">Market withdrawal orders or bans on non-compliant products and services across all Member States[6]<\/li>\n\n\n\n<li style=\"font-size:18px\">Criminal sanctions of up to <strong>\u20ac<\/strong>1 million (Luxembourg [7])<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">And yes, you can be fined repeatedly if you fail to fix the problem. Some countries, like France and Italy, allow escalating penalties over time. [8]<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">In rare but serious cases, <strong>you could even face jail time<\/strong>!&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"font-size:18px\">In Cyprus, violations can result in up to 3 years\u2019 imprisonment, though it\u2019s unclear whether this applies to directors, officers, or legal representatives [9].<\/li>\n\n\n\n<li style=\"font-size:18px\">In Ireland, individuals or companies can face up to 18 months\u2019 imprisonment, depending on the severity of the breach.[10][11]&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A real-world scenario<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">Let\u2019s say you&#8217;re a large U.S. e-commerce company with an app and kiosks used across several EU member states, and that you fall short on these key EAA requirements:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"font-size:18px\"><strong>No CE marking on your kiosks.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">The EAA requires <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A32019L0882#cpt_VII\">CE marks to appear \u201cvisibly, legibly and indelibly\u201d<\/a> on the product or its data plate. If that\u2019s not possible, then on the packaging and accompanying documentation.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"font-size:18px\"><strong>Zooming the app to 200% overlaps content and hides product prices.<\/strong><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">Visual content must provide for flexible magnification so low-vision users aren\u2019t excluded.[12]<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"font-size:18px\"><strong>Error messages rely on red text alone (so color-blind users can\u2019t tell what went wrong)<\/strong>. When color is used to convey information, an alternative cue must also be provided.[13]<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">Here\u2019s what can happen:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li style=\"font-size:18px\"><strong>Ireland<\/strong> can impose a fine of up to<strong> \u20ac60,000<\/strong> for the missing CE mark. [14]<\/li>\n\n\n\n<li style=\"font-size:18px\"><strong>Germany<\/strong> can issue administrative fines of up to<strong> \u20ac100,000<\/strong> for serious accessibility violations. [15]<\/li>\n\n\n\n<li style=\"font-size:18px\"><strong>Italy <\/strong>can<strong> <\/strong>impose<strong> <\/strong>administrative fines of up to <strong>\u20ac40,000<\/strong> if a user files a complaint, and if authorities confirm non-compliance. [16]<\/li>\n\n\n\n<li style=\"font-size:18px\"><strong>Spain<\/strong> can levy a <strong>\u20ac600,000 fine<\/strong> for a single \u201cvery serious\u201d infraction.[17]&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">That\u2019s <strong>\u20ac800,000 in fines \u2014 just across four countries<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">But what if your app is available in all 27 countries?&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">One regulator\u2019s decision can snowball. Under EU rules, a national authority must alert the European Commission and other member states when it finds a breach. Your app could then be delisted EU-wide.[18]<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Enforcement follows a clear process<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">You won\u2019t be fined \u20ac800,000 overnight. <a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2019\/882\/oj#art_20\">Enforcement under the EAA follows a structured process.<\/a>&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li style=\"font-size:18px\">First, the national authority investigates and requests full cooperation from you.<\/li>\n\n\n\n<li style=\"font-size:18px\">If a real issue is found, you get a reasonable window to fix it.<\/li>\n\n\n\n<li style=\"font-size:18px\">Only if those fixes are ignored \u2014 or incomplete \u2014 does the matter escalate.&nbsp;<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">That said, it\u2019ll clearly be cheaper in the long run to comply, especially when you consider that every day your site or app is not accessible, you\u2019re already losing business. That\u2019s the biggest fine of all.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Final thought<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">The EAA is probably the strongest push for digital inclusion in global law, and EU regulators are already writing significant penalties into national law. But the real stakes extend far beyond potential fines. Public non-compliance headlines can erode brand equity; inaccessible products shut the door on EU markets; and major buyers will simply drop vendors whose tools exclude users with disabilities.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\" style=\"font-size:18px\">But there\u2019s good news, too.
